The role of subnational regions is ill-conceived in international law scholarship, which has come to slowly accept the important role that cities can play as international actors. Opening up the academic debate for a perspective on regions promises to develop new insights on the divide of governance functions between international organizations and states, regions and cities. At the same time, the regional focus helps to unearth some of the shortcomings of overly enthusiastic approaches to what cities can do as global (...) actors. International law scholarship has found it difficult, however, to engage with the concept of the region. This is owed, as this Article demonstrates, to difficult definitional issues as well as the informalizing bend of a focus on regional governance, which is hard to square with traditions of formalist thinking in international law. Ultimately, the Article argues that regions can function as a useful prism through which to analyze current governance challenges. (shrink)

This book explores the question of how international law is applied by domestic courts. Through case studies and analysis the contributors consider how traditions and diversity affect the interpretation of international law, from a mixture of doctrinal, practical, and theoretical approaches.

Foundationalism and coherentism are two fundamentally opposed basic epistemological views about the structure of justification. Interestingly enough, there is no consensus on how to interpret Husserl. While interpreting Husserl as a foundationalist was the standard view in early Husserl scholarship, things have changed considerably as prominent commentators like Christian Beyer, John Drummond, Dagfinn Føllesdal, and Dan Zahavi have challenged this foundationalist interpretation. These anti-foundationalist interpretations have again been challenged, for instance, by Walter Hopp and Christian Erhard. One might suspect that (...) inconsistencies in Husserl’s writings are the simple reason for this disagreement. I shall argue, however, that the real question is not so much how to read Husserl, but how to define foundationalism and that there is overwhelming textual evidence that Husserl championed the most tenable version of foundationalism: a moderate foundationalism that allows for incorporating coherentist elements. Cross-cultural comparisons often investigate values that are assumed to have long-lasting influence on human conduct and thought. To capture and compare cultural values across cultures, Geert Hofstede's Cultural Dimensions Theory has offered an influential framework. Hofstede also provided a survey instrument, the Values Survey Module (VSM), for measuring cultural values as outlined in his Cultural Dimensions Theory. The VSM has since been subject to a series of revisions. Yet, data on countries have been derived from the original VSM — and (...) not on one of the revised versions of VSM. We tested three scales (indulgence, power distance, and individualism) from the latest version, the VSM 2013, as part of a larger survey across 57 countries. Two main findings emerged. For one thing, country scores based on the VSM 2013 scales correlated only weakly with country scores of the same cultural dimensions obtained in a large previous study. Thus, the validity of the VSM 2013 is in doubt. For another thing, the internal consistency of the VSM 2013 scales was overall poor, indicating that the scales did not reliably measure well-defined constructs. This book offers a phenomenological conception of experiential justification that seeks to clarify why certain experiences are a source of immediate justification and what role experiences play in gaining (scientific) knowledge. Based on the author's account of experiential justification, this book exemplifies how a phenomenological experience-first epistemology can epistemically ground the individual sciences. More precisely, it delivers a comprehensive picture of how we get from epistemology to the foundations of mathematics and physics. The book is unique as it utilizes methods (...) and insights from the phenomenological tradition in order to make progress in current analytic epistemology. It serves as a starting point for re-evaluating the relevance of Husserlian phenomenology to current analytic epistemology and making an important step towards paving the way for future mutually beneficial discussions. This is achieved by exemplifying how current debates can benefit from ideas, insights, and methods we find in the phenomenological tradition. (shrink)

The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. The inherent value conception of dignity,as here defended, is what is meant in the Swiss Constitution article. (shrink)

During a pandemic, demand for intensive care often exceeds availability. Experts agree that allocation should maximize benefits and must not be based on whether patients could have taken preventive measures. However, intensive care units are often overburdened by individuals with severe COVID-19 who have chosen not to be vaccinated to prevent the disease. This article reports an experiment that investigated the German public's prioritization preferences during the fourth wave of the coronavirus pandemic. In a series of scenarios, participants were asked (...) to decide on ICU admission for patients who differed in terms of health condition, expected treatment benefits, and vaccination status. The results reveal an in-group bias, as vaccinated individuals preferred to allocate more resources to the vaccinated than to the unvaccinated. Participants also favored admitting a heart attack patient rather than a COVID-19 patient with the same likelihood of benefiting from ICU admission, indicating a preference for maintaining regular ICU services rather than treating those with severe COVID-19. Finally, participants were more likely to admit a patient to intensive care when this meant withholding rather than withdrawing care from another patient. The results indicate that lay prioritizations violate established allocation principles, presaging potential conflicts between those in need of intensive care and those who provide and allocate it. It is therefore recommended that allocation principles should be explained to enhance public understanding. Additionally, vaccination rates should be increased to relieve ICUs and reduce the need for such triage decisions. (shrink)

Barnett and Block (J Bus Ethics 18(2):179–194, 2011 ) argue that one cannot distinguish between deposits and loans due to the continuum problem of maturities and because future goods do not exist—both essential characteristics that distinguish deposit from loan contracts. In a similar way but leading to opposite conclusions (Cachanosky, forthcoming) maintains that both maturity mismatching and fractional reserve banking are ethically justified as these contracts are equivalent. We argue herein that the economic and legal differences between genuine deposit and (...) loan contracts are clear. This implies different legal obligations for these contracts, a necessary step in assessing the ethics of both fractional reserve banking and maturity mismatching. While the former is economically, legally, and perhaps most importantly ethically problematic, there are no such troubles with the latter. (shrink)

Multiscale modeling techniques have attracted increasing attention by philosophers of science, but the resulting discussions have almost exclusively focused on issues surrounding explanation (e.g., reduction and emergence). In this paper, I argue that besides explanation, multiscale techniques can serve important exploratory functions when scientists model systems whose organization at different scales is ill-understood. My account distinguishes explanatory and descriptive multiscale modeling based on which epistemic goal scientists aim to achieve when using multiscale techniques. In explanatory multiscale modeling, scientists use multiscale (...) techniques to select information that is relevant to explain a particular type of behavior of the target system. In descriptive multiscale modeling scientists use multiscale techniques to explore lower-scale features which could be explanatorily relevant to many different types of behavior, and to determine which features of a target system an upper-scale data pattern could refer to. Using multiscale models from data-driven neuroscience as a case study, I argue that descriptive multiscale models have an exploratory function because they are a sources of potential explanations and serve as tools to reassess our conception of the target system. In the past decade, the fields of machine learning and artificial intelligence (AI) have seen unprecedented developments that raise human-machine interactions (HMI) to the next level.Smart machines, i.e., machines endowed with artificially intelligent systems, have lost their character as mere instruments. This, at least, seems to be the case if one considers how humans experience their interactions with them. Smart machines are construed to serve complex functions involving increasing degrees of freedom, and they generate solutions not fully anticipated by humans. (...) Consequently, their performances show a touch of action and even autonomy. HMI is therefore often described as a sort of “cooperation” rather than as a mere application of a tool. Some authors even go as far as subsuming cooperation with smart machines under the label ofpartnership, akin to cooperation between human agents sharing a common goal. In this paper, we explore how far the notion of shared agency and partnership can take us in our understanding of human interaction with smart machines. Discussing different topoi related to partnerships in general, we suggest that different kinds of “partnership” depending on the form of interaction between agents need to be kept apart. Building upon these discussions, we propose a tentative taxonomy of different kinds of HMI distinguishing coordination, collaboration, cooperation, and social partnership. (shrink)

Denn erstens ist unser Wissen begrenzt. Skeptiker*innen meinen sogar: sehr eng begrenzt. Zweitens kann man in kontroversen Fragen manchmal den Eindruck bekommen, dass die Wahrheit vom Standpunkt der Betrachtenden abhängt. Dementsprechend behaupten Relativist*innen, dass es oft keine objektive Wahrheit gibt. Derlei Bedenken nehmen bereits jetzt starken Einfluss auf die Meinungsbildungsprozesse in unserer Gesellschaft. Recent interest in phenomena of simulation, pretense, and play has given rise to new philosophical debates on the basic structure of human action and action planning. Some philosophers sought to transform Hume's desire-belief-action model by sophisticating its basic structure. For example, they introduced “hypothetical world boxes” or imaginary “i-desires” and “i-beliefs” into the standard model, in order to account for the representational and motivational structures of imaginary scripts. Others used phenomena of behavior driven by imagination to attempt a more fundamental (...) critique of the Humean tradition. This article aims to show how the pragmatist tradition could be used as a resource in reframing current debates on imagination, pretense, and simulation in the cognitive sciences. This will help determine the role of imagination in intelligent human deliberation. (shrink)

‘India’s founding moment’ a moment of breath-taking political imagination and it is one of the great achievements of Madhav Khosla. to unpack important parts of its pre-history and emergence. This article will look at two questions—one about alternatives and the other about contexts. Regarding alternatives, I am interested in the paths not taken and an understanding of possibilities. I try to get a sense of possible alternative futures or modernities that the founding generation pondered, in the best case allowing us (...) to wonder what we can learn from the choices made as well as from the paths rejected. The other question I raise is the question of the intellectual contexts, in which the founding took place. Coming from a non-Indian perspective, I am interested in the entanglements, the contexts and potentially migrating ideas that emerge. (shrink)

Wie verhalten sich Freiheit und Staatlichkeit in Kants Rechtslehre? Und welche Bedeutung kommt hierbei seiner kritischen Moralphilosophie zu? Hirschs Untersuchung zeigt, dass bei Kant Recht und Staat notwendige Realisationsbedingungen individueller Autonomie sind. Erst als autonome und selbstzweckhafte Personen haben wir Freiheitsrechte, welche wir aber nur im Staat legitim behaupten können. Denn nur unter der Idee von Staatlichkeit als Vereinigung des gesetzgebenden Willens aller kann rechtliche Fremdverpflichtung als Selbstverpflichtung begriffen werden. Staatlichkeit dient damit der Verwirklichung individueller Autonomie und Freiheit. Hierin liegt (...) das Reformideal politischer Herrschaft. Doch Rechtsdurchsetzung gegen den Staat ist unmöglich, sodass aktiver Widerstand nie rechtens, aber mitunter entschuldbar ist. Damit gelingt es Hirsch erstmals, Kants Rechts- und politische Philosophie ausgehend vom kategorischen Imperativ als integralen Bestandteil seiner kritischen Moralphilosophie auszuweisen. Gleichzeitig lässt sich so erklären, wie Anerkennung individueller Freiheitsrechte, staatlicher Rechtszwang und unbedingte staatsbürgerliche Gehorsamspflicht als Ausdruck des politischen Liberalismus Kants miteinander vereinbar sind. Depositors have perceived banks as acting unethically during the most recent recession. One area of consternation is the ambiguity of the legal obligations entailed by the deposit contract when it is backed with only fractional reserves. In this article, we apply an existing analysis of the legitimacy and ethicality of banking practices to a wider range of financial transactions, including insurance policies, securities lending, perpetual bonds, and callable loans. Securities lending in particular creates rights violations analogous to those in fractional-reserve (...) banking. Both callable loans and perpetual bonds have clear legal obligations which are not inherently problematic, though we herein clarify what these obligations are. Finally, we apply our ethical framework to demonstrate that insurance products are distinct from banking deposit contracts, and that perceived parallels between the two products underestimate these differences. As vaccines against COVID-19 are scarce, many countries have developed vaccination prioritisation strategies focusing on ethical and epidemiological considerations. However, public acceptance of such strategies should be monitored to ensure successful implementation. In an experiment withN=1379 German participants, we investigated whether the public’s vaccination allocation preferences matched the prioritisation strategy approved by the German government. Results revealed different allocations. While the government had top-prioritised vulnerable people (being of high age or accommodated in nursing homes for the elderly), participants preferred exclusive (...) allocation of the first available vaccines to medical staff and personnel caring for the elderly. Interestingly, allocation preferences did not change when participants were told how many individuals were included in each group. As differences between allocation policies and public preferences can affect trust in the government and threaten the social contract between generations, we discuss possible strategies to align vaccination prioritisations. The aim of this note is to determine whether certain non-o-minimal expansions of o-minimal theories which are known to be NIP, are also distal. We observe that while tame pairs of o-minimal structures and the real field with a discrete multiplicative subgroup have distal theories, dense pairs of o-minimal structures and related examples do not.

This article probes the relationship between archives and history by examining the archive policy on historical research in the first modern administration state of the German lands, the kingdom of Bavaria. Given the continuing tradition of the theory and practice of the arcana imperii in the 19th century, state archives served first and foremost the state. As a result, researchers’ interest in archival material was to undergo an administrative vetting procedure, in order to safeguard the interests of the state. By (...) examining comparatively the cases of two petitioners supplicating for the historical use of state archives in Munich, the article showcases the policy of secrecy and the resultant administrative threshold separating the sphere of the arcana from the public. Caution guided the archive politics of state officials and, ultimately, their more or less explicit notions and concerns decided which material was finally to be released, in order to become a ‘source’ for historical study. Historical researchers such as the writer Alessandro Volpi and the historian August Kluckhohn were thus required to meet specific criteria and to overcome political hurdles, in order to gain access to the desired clues guarded by the state. As a result of this, the opportunity to inspect archival material was very much dependent on the political communication between petitioner and government, and its result, the granting or denial of access, was not without ramifications for historical research and the epistemic status of historical knowledge. Sie bietet damit auch einen Einstieg in das politische Denken der Moderne und den Ursprung der modernen politischen Bewegungen und Parteien.
